Use and Service Agreement for Patients

1. Contracting parties and subject matter
This use and service agreement is concluded between BGGI GmbH, Rostocker Straße 43, 53117 Bonn, HRB 26753 Local Court Bonn (“BGGI”), and the user who accepts it digitally via the BGGI Health platform (“Patient”).
Its subject is the arrangement and organisation of medical treatments in Germany and the booking of support services via the platform. The treatment contract itself is concluded directly with the treating physician or clinic; BGGI does not provide medical treatment.
2. Services provided by BGGI
BGGI prepares the Patient's request, forwards it to suitable physicians or clinics, obtains responses and cost plans and organises appointments.
On request, the Patient books further services via the platform, for example interpreting, personal accompaniment, transfer, visa invitation letters or help with accommodation. Communication takes place in the Patient's language.
3. Handling via the platform
(1) Services initiated or booked via the platform are handled and paid via the platform.
(2) For a treatment episode arranged via the platform, the Patient undertakes not to make agreements with the physician or clinic bypassing the platform in order to avoid service fees. If this happens nevertheless, BGGI's claim to remuneration for arrangement and support services already rendered remains in force.
(3) The Patient's free choice of physician remains unaffected.
4. Prices and payment
All prices are shown transparently in the platform before booking. Payment is made via the payment methods offered in the platform. Cancellations and refunds are governed by the General Terms and Conditions.
5. Duties of the patient
The Patient provides truthful and complete information, uploads readable documents and informs BGGI in good time about changes or cancellations. Incomplete or incorrect information can delay the arrangement or make it impossible.
6. Data processing
The processing of personal data is governed by the platform's privacy policy.
For health data (Art. 9 GDPR), BGGI obtains a separate, explicit consent. This consent is voluntary, can be revoked at any time with effect for the future and is not part of this agreement. Without it, certain services — in particular forwarding medical documents to physicians and clinics — cannot be provided.
7. Right of withdrawal
Consumers have the statutory right of withdrawal. Details are set out in the withdrawal notice on the platform.
8. Liability
BGGI is liable without limitation for intent and gross negligence and for injury to life, body and health. Otherwise BGGI is liable only for the breach of essential contractual duties, limited to the foreseeable damage typical for the contract.
The treating physician or clinic is solely liable for the medical treatment.
9. Term and termination
The agreement runs for an indefinite period. The Patient may end it at any time in text form. Services already booked are governed by the respective cancellation rules of the General Terms and Conditions.
10. Final provisions
The law of the Federal Republic of Germany applies. Mandatory consumer-protection provisions of the state in which the Patient has their habitual residence remain unaffected.
Should individual provisions be invalid, the remainder of the agreement remains effective. The German version of this agreement prevails; translations are for information only.
